Frequently Asked Questions

Notary or Lawyer?

Can I use a lawyer instead of a notary for my real estate closing?

No. In Québec, only a notary can finalize a real estate transaction — drafting the deed of sale, verifying titles, handling the funds, and registering the transaction with the land registry. A lawyer cannot replace this role.

Signing

Can I sign my documents online?

Not yet. Unlike in some other provinces, Québec law requires notarial deeds to be signed in person. But everything else can be done remotely — your quote, document uploads, communication with the notary, and file tracking.

Fees and Costs

How much does a notary cost with Notairo?

Fees vary depending on the type of closing (purchase, sale, refinancing), the complexity of the file, and the disbursements. With Notairo, you always receive a clear, detailed quote upfront — with no hidden fees.

What are disbursements?

These are costs the notary pays on your behalf, such as land registry fees, official copies, or certificates. They’re billed back to you at cost, on top of the notary’s fees.

Documents

What documents do I need to provide?

It depends on your type of transaction, but usually:

  • Your offer to purchase or deed of sale
  • Contact information for all parties involved
  • Valid ID
  • Financing details (e.g. mortgage approval)
  • A valid certificate of location (for a sale)

Don’t worry — Notairo will send you a clear, personalized checklist as soon as your file is opened.

Buying and Selling

If I’m buying, can I choose my notary?

Yes. In Quebec, the buyer usually chooses the notary, unless both parties agree on a common choice.

If I’m selling, do I also need a notary?

Yes, but in most cases, it’s the buyer’s notary who manages the closing. As a seller, you may still need to provide certain documents, such as an up-to-date certificate of location.

Refinancing

Why do I need a notary for refinancing?

Because the notary must formalize the new mortgage, register it with the land registry, discharge the previous one (if applicable), and make sure everything complies with Québec law. Even if you’re staying in the same property, this step is mandatory.

Security

Are my documents and data safe with Notairo?

Absolutely. Notairo uses a secure digital infrastructure to collect and process your documents. Only authorized people (you, your notary, and our support team) can access your information.

Timelines

How long does a notarial closing take?

On average:

  • Purchase or sale: 3–4 weeks after the offer is accepted
  • Refinancing: 1–2 weeks, sometimes less
  • Rush closings: possible, depending on availability and how quickly documents are provided

The key? Start early and send in your documents promptly.
